近日，北京市高級人民法院(Beijing Municipal High People's Court)終審認(rèn)定美國蘋果公司在"IPHONE"商標(biāo)異議復(fù)審行政糾紛一案中敗訴，使得這家美國公司不得不與北京一家皮革產(chǎn)品制造商共用此商標(biāo)(share the trademark with a Beijing-based leather products maker)。據(jù)悉，新通天地主營帶有"IPHONE"字樣的智能手機外殼(smartphone cases)、手袋(handbags)等多種皮革制品(leather products/goods)。

報道稱，2002年，蘋果公司就向中國商標(biāo)局申請注冊"IPHONE"商標(biāo)(apply for the "IPHONE" trademark)，不過直到2013年才獲得核準(zhǔn)(be approved until 2013)，核定使用在國際分類第9類計算機硬件、計算機軟件(computer hardware and software)等商品上。2007年，新通天地公司向商標(biāo)局提出注冊"IPHONE"商標(biāo)的申請，申請在國際分類第18類仿皮(artificial leather)、牛皮、錢包(wallet)、小皮夾、皮制繩索等商品上使用。

商標(biāo)局發(fā)布初審公告后，蘋果公司提出了異議，認(rèn)為其"IPHONE"商標(biāo)在第9類移動電話機(mobile phone)商品上已經(jīng)取得極高的知名度(enjoy high popularity)和顯著性，理應(yīng)被認(rèn)定為馳名商標(biāo)(well-known brand)。不過商標(biāo)局卻核準(zhǔn)了被異議的商標(biāo)注冊。為獲得"iPhone"商標(biāo)在華的獨家使用權(quán)(the exclusivity on the use of the "iPhone" trademark in China)，蘋果又向北京第一中級人民法院(Beijing First Intermediate People's Court)提起訴訟，但該法院也對其訴訟請求予以駁回，于是蘋果向北京市高級人民法院提起上訴。

對于北京市高級人民法院日前的判決，蘋果并不滿意。在當(dāng)?shù)貢r間5日發(fā)布的一條新聞聲明中，該公司表示將向最高人民法院提起復(fù)審請求(request a retrial with the Supreme People's Court)，繼續(xù)堅決保護己方商標(biāo)的合法權(quán)益(continue to vigorously protect our trademark rights)。
